These terms are drawn up in accordance with the Italian Consumer Code (Legislative Decree 206/2005) and Legislative Decree 70/2003 on electronic commerce. The contract is concluded at a distance. These terms are provided in Italian and in English; in case of discrepancy the Italian version prevails.

Subject matter

The terms govern the distance sale, through this site, of the products in the catalogue. By submitting an order you declare that you have read these terms, the privacy notice and the Shipping and Returns and withdrawal pages, and that you accept them.

Products and availability

Each product page shows the essential characteristics, the images and any variants. Images are indicative; for technical details the description prevails. Availability is shown on the product page but may change between viewing and submitting the order. If an ordered product is no longer available, we will inform you without delay and refund anything you may already have paid, or agree an alternative with you.

Prices

Prices are expressed in euro and include VAT. Shipping costs are not included and are shown in the cart and in the checkout summary before confirmation, as described on the Shipping page: in Italy they are free, while to euro area countries they cost €14.99 per order. The total you pay is always shown before you submit the order. In case of an obvious pricing error we may decline to follow up the order, with a full refund of what was paid.

Order and conclusion of the contract

To buy, add the products to the cart, go to checkout, enter the required details, choose the payment method and confirm. Before confirming you can check and correct the data entered and the content of the order.

Submitting the order is an offer to purchase. The contract is concluded when we send you the order confirmation by email, which contains a summary of the products, the price, the shipping costs and a reference to the rights of withdrawal and warranty. We recommend that you keep this email; you can always print or save these terms. We may refuse or cancel an order for legitimate reasons, for example unavailability of the product, obvious errors or suspected fraud, refunding anything already paid.

Payments

You can pay by credit or debit card, including through compatible digital wallets when available, and with PayPal. Payments are processed by Stripe and PayPal, which are responsible for the security of card data: we neither know nor store the full number. The charge is made at the time of the order, according to the rules of the chosen method. If the payment does not go through, the order is not confirmed.

Shipping and delivery

Costs, times, countries served and delivery methods are described on the Shipping page, which is part of these terms. Unless otherwise agreed, we deliver within 30 days of the conclusion of the contract (article 61 of the Italian Consumer Code). If delivery is late, you can ask us to deliver within an appropriate additional period and, if we fail to do so, terminate the contract and obtain a refund. The risk of loss of or damage to the goods passes to you when you take physical possession of them (article 63).

Right of withdrawal

As a consumer you have the right to withdraw from the contract within 14 days of delivery, without giving a reason, under articles 52 et seq. of the Italian Consumer Code. The conditions, exceptions, return costs, refund and model form are on the Returns and withdrawal page.

All products are covered by the legal warranty of conformity provided by articles 128 et seq. of the Italian Consumer Code. The seller is liable for lack of conformity that becomes apparent within two years of delivery of the goods. A defect that becomes apparent within one year of delivery is presumed to have existed at that date, unless proven otherwise or unless this is incompatible with the nature of the goods or of the defect.

In case of a defect you are entitled, at your choice, to repair or replacement of the goods, free of charge; if these remedies are not possible, are excessively burdensome or have not been carried out within a reasonable time, you are entitled to a price reduction or to termination of the contract, in the cases and within the limits provided by law. To claim the warranty write to us at info@viemylu.com describing the defect, with the order number and, if possible, photos or a video. The legal warranty does not cover normal wear and tear, damage caused by improper use or use other than that intended, or defects that you knew about at purchase. Any commercial warranty offered by the manufacturer remains unaffected, being in addition to the legal one and not replacing it.

Liability

We are liable within the limits provided by law. Nothing in these terms excludes or limits liability that cannot be excluded by law, or the consumer's inalienable rights. We are not liable for delays or non-performance due to causes not attributable to us, such as force majeure, or to use of the product contrary to the instructions. The site may be temporarily unavailable for maintenance or technical reasons.

Intellectual property

Texts, images, graphics, logo and contents of the site are protected by copyright and trademark law. Manufacturers' trademarks belong to their respective owners. Without written authorisation you may not reproduce, copy or reuse the contents for commercial purposes.

Privacy

Personal data is processed in accordance with the privacy notice, under Regulation (EU) 2016/679. For cookies and storage see the cookie policy.

Complaints and dispute resolution

For complaints and reports write to info@viemylu.com: we will look for a quick and amicable solution. If we have not been able to resolve the matter, as a consumer you can turn to an alternative dispute resolution (ADR) body listed in the register kept by the competent authorities, under articles 141 et seq. of the Italian Consumer Code, without prejudice to your right to go to court. Information on ADR bodies is available on the websites of the competent authorities. Our participation in an ADR procedure is not compulsory, unless the law provides otherwise.

Governing law and jurisdiction

The contract is governed by Italian law. If you are a consumer, the mandatory consumer protection rules of the country where you live remain unaffected. For any dispute relating to the contract, the court of the consumer's place of residence or domicile has exclusive jurisdiction, if located in Italy (article 66-bis of the Italian Consumer Code). If you live in another country of the European Union, the mandatory consumer protection rules of your country and your right to bring proceedings before the courts of the country where you live remain unaffected.

Changes to the terms

We may change these terms to adapt them to changes in the law or in the service. Changes apply to orders submitted after publication; orders already concluded remain governed by the version in force at the time of purchase. The date of the last update is shown at the top.
